Former city employee pleads guilty in insurance claims scheme

Patsy Leathers of Rowlett, a former city of Garland employee, pleaded guilty Wednesday, Dec. 15 to involvement in a scheme to embezzle $1.9 million dollars over a 14-year period beginning in 1994.  Leathers admitted that while she was employed by the city to investigate and resolve third-party liability claims, she conspired with others to create bogus claims for damages and repairs.

According to a U.S. Department of Justice press release, checks to cover the false claims were issued in the real names of co-conspirators, as well as fictitious names, then cashed by the co-conspirators who shared the proceeds with Leathers.

She is scheduled to be sentenced on March 18 and faces a sentence of five years prison time along with a $250,000 fine and restitution. 

On Dec. 8, Connie Powell, Leathers’ sister, pleaded guilty to her role in the conspiracy and faces the same potential sentence.  She will be sentenced on March 2.

Leathers, who had been employed by the city of Garland for more than 20 years, was originally arrested for the crime in March, 2008 along with alleged co-conspirators Jerry Don Diviney and Duane Milford Stailey.  At that time, the three were charged with Engaging in Organized Criminal Activity, which is a first degree felony.

The status of the cases against Diviney and Stailey was not disclosed during Leathers’ plea agreement.

The crime was uncovered by Garland police investigators, city management, and the city’s Internal Audit Department.  City officials asked for FBI assistance in the investigation of the conspiracy. 

The ongoing investigation is being conducted by the FBI, the Garland Police Department, the Garland City Attorney, and the Garland Internal Auditor.

Officer struck by suspected drunk driver

Shortly after 1:00 am this morning Garland police officer Jason Voelz was struck by a suspected drunk driver while standing outside of his squad car on George Bush Tollway at Holford Road.

The five-year police veteran had placed a female prisoner into the back seat area of his squad car when a car apparently veered off the main part of the roadway and onto the shoulder of the road.  The car then struck both the squad car and the officer. 

The officer was flown by helicopter to Parkland Memorial Hospital of Dallas in serious condition.  He underwent surgery for some of his injuries this afternoon and is listed in stable condition. 

The female prisoner and suspected male drunk driver were transported to Baylor Hospital of Garland where they were reported to have non-life threatening injuries.

Texas Department of Public Safety Officers responded to the scene and are conducting the investigation.  DPS will be filing charges in the case.

Local homeowner/off-duty Dallas police officer shoots burglar

Garland police responded to a suspicious persons call this afternoon shortly before 1:30 pm in the 3400 block of Capstone Lane, in the south part of Garland. The caller said there was a black SUV driving the neighborhood and the people were going door-to-door and knocking on the front doors. The caller hung up once police were on the way. 

The caller called back several minutes later and stated he thought there was someone about to break into the back door of his home, that he had a gun and was a Dallas police officer.  About that time he heard the back door crash open, and he went toward the back door.  He saw a man standing in his house and he fired his gun toward the man.  The man turned and ran out of the house onto the back driveway and down the alley.  When Garland officers arrived they were able to locate and follow a trail of blood drops down the alley to a point where they stopped.  Police believe it was at that point where the suspect was most likely picked up by the SUV.

Police advised Dallas area hospitals of the shooting and alerted Department of Public Safety who sent up their helicopter to try and locate the suspect vehicle.  Almost an hour later police learned of a man who had checked into a Dallas hospital with a gunshot wound. Officers responded to check on the circumstances of the wounded man. 

A short while later the Department of Public Safety helicopter officers located a vehicle matching the suspect vehicle description and alerted police on the ground.  Police found the vehicle and a man inside the SUV.  Police are talking with him as a possible suspect in the burglary investigation.  Police believe there is a third man and are working to identify who he may be.  Detectives are continuing to investigate the circumstances around wounded man being shot and the man found in the SUV matching the suspicious vehicle call. 

When and if either man is arrested for today’s burglary in the 3400 block of Capstone, their name will be released.


33-year-old holds parents hostage

Garland Police responded to the 4900 block of Berkeley Court just after 6:00 a.m. the morning Sept. 28 on the report of man being held hostage.  As officers were arriving, they spotted the possible suspect, 33- year-old Jhmad Swindell, leaving the area.  As one of the officers began to follow the vehicle the other officer contacted the complainant, Jhmad’s father.  He confirmed that Jhmad had just left in a vehicle and told the officer that Jhmad had come to his home with a shot gun and was very upset over a previous arrest and other life problems.  Jhmad held both his dad and mom at gun point while talking about his problems.

As the officer was talking with Mr. Swindell, the other officer attempted to stop Jhmad in his vehicle around the IH 30 and Rosehill Road area.  As the officer attempted to make the traffic stop Jhmad began to flee and headed west on IH 30.  The pursuit continued west into Dallas on IH 30, turned south on Buckner and finally ended at Buckner and Highway 175 in a service station parking lot.  Dallas police arrived and assisted Garland police in taking Jhmad into custody.  The shotgun believed to have been used to hold his parents hostage was recovered from the vehicle.

Jhmad is being held on charges of aggravated assault-deadly weapon, aggravated kidnapping (criminal attempt), evading arrest in a vehicle and unlawful possession of a firearm by a felon.
